License Agreement

This End User License Agreement (“Agreement”) is between you and the makers of HeyCaption (“we”, “us”) and covers the HeyCaption app for macOS (the “Software”). By installing or using the Software, you agree to it. If you don't agree, don't install or use the Software.

When you buy a license, we grant you a non-exclusive, non-transferable license to install and use the Software on 1 Mac that you own or control. To move it to a new Mac, remove the old Mac at heycaption.com/activate, then activate the new one.

• Pro license. A yearly subscription that renews automatically. Cancel anytime; Pro stays active until the end of the year you paid for.
• Lifetime license. Perpetual. It doesn't expire and never needs renewing.
• Free trial. Without a license, you can caption up to 3 videos to try the Software.

You may use the Software for personal or commercial work, including captioning videos for clients. Captions and videos you create are yours, with no watermark on paid licenses. Teams and businesses need one license for every Mac the Software is installed on.

You may not:

• Share, sell, rent, lend or publish your license key
• Activate one license on more than 1 Mac at a time
• Copy, modify, decompile or reverse engineer the Software, except where the law expressly allows it
• Remove or bypass licensing, trial limits, copyright notices or other protections in the Software
• Use the Software to caption media you don't have the right to use or modify

A Pro license includes every update we release while it's active. A Lifetime license includes every new version of HeyCaption we release, for as long as we develop and sell it, at no extra cost. Updates are covered by this Agreement unless they come with their own terms.

The Software is licensed, not sold. We keep all rights, title and interest in the Software, including all intellectual property rights. Your videos, transcripts and exported captions belong to you.

The Software transcribes and renders your videos on your Mac and never uploads them. Activating a license contacts our licensing service to verify your key. See our Privacy Policy.

This Agreement stays in effect until it ends. It ends automatically if you breach it, or if your purchase is refunded or charged back. When it ends, you must stop using the paid features of the Software. See our Refund Policy.

The Software is provided “as is”, without warranty of any kind. To the extent the law allows, we disclaim all warranties, including merchantability, fitness for a particular purpose and non-infringement. Captions are generated automatically, so please review them before you publish.

To the extent the law allows, we aren't liable for any indirect, incidental or consequential damages, or for loss of data, arising from your use of the Software. Our total liability is limited to the amount you paid for your license.

If any part of this Agreement is found unenforceable, the rest stays in effect. This Agreement works alongside our Terms of Use.
